A controversy regarding the Hague Convention on the Civil Aspects of International Child Abduction 1980, Human Rights Act and the UN Convention on the Rights of the Child and Emily Rose Hindle (a minor) and her father, Karl Ernest Hindle (a British citizen) and the United States of America and the State of Florida




Application for Directions



1. Emily Rose Hindle, a minor child was born on 1st March 2002 in Maldon, Essex UK with a mother being, Sheila Kay Fuith a US citizen and Karl Ernest Hindle, a British citizen; all were resident in the UK and lived together; the mother and father were not married;
2. The parties met in New York in December 2000 however the mother concealed the fact that she was married with two minor children in Minnesota from the father and continued to do so after she moved to the UK to live with the father in February 2001;
3. The child was diagnosed at age 6 months with a medical condition rendering her blind in her right eye unless treated and treatment commenced at Broomfield Hospital, Chelmsford UK which involved patching of the eye for several hours each day together with regular weekly visits to the hospital;
4. 2. On 7th January 2003, the mother removed the child from the home and attended the US Embassy London claiming to be a victim of domestic violence at the hands of the father and without his knowledge or consent, a US passport was issued to the minor child who was removed to the United States;
5. Upon being removed to the United States on or around 23rd February 2003, the child was hidden with the assistance of US Department of State and US Embassy officials from the father amidst claims he was an abuser in order to evade the US legal process and conceal the child; to date the child has been moved and concealed in ten US States and moved over 60 times;
6. The mother unilaterally and without taking medical advice ceased treatment for the child’s blindness;
7. In March 2003 the child was placed up for an unlawful adoption arrangement known in the US as a “baby switch” for which the father will testify to his own certain knowledge involved payment to the mother;
8. The sale of the child placed her into the care and contact of Leslie Merriam, a convicted child sex offender in Wisconsin;
9. The father attempted to litigate in March 2003 in the state of Minnesota where the mother was traced to at that time however he was advised by US attorneys instructed that there was no jurisdiction in that state and that jurisdiction in their view lay in the UK;
10. The father subsequently attempted to litigate in the state of Wisconsin in April 2003 after the mother was traced there and again was advised by retained attorneys in Wisconsin that there was no jurisdiction in that state and that jurisdiction lay in the UK;
11. The father attempted to invoke the Hague Convention for the return of the child but was advised by the English Central Authority this was not possible due to lack of parental responsibility;
12. The father and the English Central Authority repeatedly requested the intercession of the US authorities to protect the child but were ignored;
13. The father has now obtained US police reports that state that the mother and child were removed from the UK by the US Embassy London and US Department of State, Washington DC on the grounds that the father was an abuser and was not to know where the child was in the United States;
14. The father applied for a parental responsibility order out of Chelmsford County Court and after substituted service this was granted to the father on 14th August 2003;
15. The mother agreed to produce the child in Florida in August 2003 after the father approached the US Federal Bureau of Investigation;
16. The father offered reconciliation to the mother if she returned to the UK with the child to which she agreed;
17. On 19th September 2003, upon arriving at Gatwick Airport the mother was denied entry to the UK on the grounds of a previous overstay; British police alerted to the issues concerning the child removed the child from the care of the mother and placed her in the care of the father who refused permission under his parental responsibility order for the child to be removed from the jurisdiction;
18. The father does not deny he engineered this state of affairs though refusal of the mother for entry to the UK was not requested nor his intent and this was harsh treatment; the intent was to ensure the safety and welfare of the child from the neglect and conduct of the mother;
19. Upon the child being placed in his care, the father notified US and UK authorities as well as the mother’s family in the United States and immediately filed in Chelmsford County Court for a residency order;
20. The County Court proceedings were stayed by the High Court as an application was filed under the Hague Convention claiming jurisdiction lay in the State of Florida on the grounds that the child had resided there for more than six months – the father can now demonstrate that this was a fraudulent claim on the part of the mother and the US Central Authority official who filed it, Barbara J Greig and that the mother was in the jurisdiction for less than 2 months;
21. The High Court was also advised that the US passport issued to the child had been lawfully issued by the US Embassy; the father can now show that the child was issued a US passport in violation of US passport law and as a consequence of a domestic violence fraud and/or a signed notarised consent fraud;
22. A Hague Convention hearing was held before Sir Justice Johnson who delivered his ruling on 3rd October 2003 and ordered the return of the child subject to medical treatment being rendered for her eye condition amongst other conditions including visitation;
23. The father can now show that the Hague Convention application and evidence provided by the US Central Authority represents a fraud on the High Court by Barbara Greig, the US Government and the mother;
24. Upon sending the child to the State of Florida the father filed in that State for relief;
25. In November 2003 the father was advised by the US Central Authority’s Glenn Keiser, that his visa waiver privileges had been revoked and he needed a visa from the US Embassy to travel to the US for court hearings; the father believes he can now demonstrate that the US Central Authority used the visa process to deny the father access to the child and to the US courts and did so in order to conceal the misconduct of its own officials;
26. The father applied for a visa for attendance at a hearing in January 2004 and this was refused by the US Embassy London on the recommendation of Barbara Greig of the US Central Authority;
27. The father reapplied for a visa to travel for hearings in April 2004 and was issued with a restricted visa for a short visit and was further advised he could not have a visa for visitation with his child;
28. Upon entering the United States the father commenced the legal process and was served on behalf of the mother with domestic violence proceedings which required he stay in the US beyond his planned date of departure;
29. The father applied for a visa extension in accordance with instructions from US Immigration and remained to defend the domestic violence proceedings and gain access under the domestic process to the child;
30. The father successfully defended himself against the domestic violence proceedings and was successful in obtaining legal and actual access to the child;
31. On 28th May 2004 the father was arrested by US Immigration on the grounds that he had filed for an extension to his visa one working day late and the father understands that this is a unique application of the law by US Immigration officials;
32. The father can now show that his arrest was at the direct request of Barbara J Greig of the US Central Authority who did not agree with the findings of the US court and conspired with the mother to effectuate a technical violation of the visa by using access to the child on the fathers intended day of departure as a lure to keep him in the US and by the service of domestic violence proceedings to be heard after the original visa expired;
33. The father can now show that Barbara J Greig did perform an unlawful investigation claiming the father was a threat and a menace and did solicit and obtain falsified police reports filed by the mother and her proxies including Captain Alan Osowski of Volusia County Sherriff’s Office;
34. The father can show that Captain Alan Osowski falsified a police report he took in November 2003 claiming the father had telephoned the mother harassing her and logging telephone numbers calling her mobile cell phone despite some of these numbers being disconnected some 11 months previously;
35. The father can now show that a conspiracy to stop the legal proceedings in the UK and in the State of Florida together with denial of the father and child’s right of access and visitation has been in force since the child’s removal from the United Kingdom in February 2003 and in which the following are members are (but are not limited to):
a. Barbara J Greig – US Department of State, US Central Authority
b. Glen Keiser – US Department of State, formerly US Central Authority
c. Sheila Kay Fuith – mother;
d. Captain Alan Osowski – Volusia County Sherriff’s Office, Florida
e. Teresa Anderson – Attorney at Law, Florida
36. This conspiracy continues to this day;
37. Upon arrest by US Immigration the father was incarcerated and on the recommendation and representations of Barbara Greig of the US Central Authority, no bond or release on recognizance was to be allowed as according to Ms Greig the father constituted an abduction threat contrary to the findings of the US judge who had seized the case;
38. The father was deported to the UK in July 2004;
39. The child subsequently disappeared and was classified as missing and endangered by the Florida Department of Law Enforcement after British police filed the child as missing through Interpol ;
40. The British police were conducting a second criminal investigation into the father based on complaints of the mother and representations of Barbara Greig to the British and US law enforcement authorities;
41. The father was cleared of allegations of harassment and stalking by the British police but the investigating officers became concerned for the safety of the child as a result of their investigations resulting in a missing child report being filed;
42. The father was denied access to the US and the courts at this time on the grounds that he had harassed the US mother despite repeated findings of the US court and law enforcement to the contrary and the child being missing and classified as endangered;
43. The father was also advised by the US Embassy London on numerous occasions that he would never be allowed access to the US for court ordered visitation with the child on the grounds he had harassed the US citizen mother despite the findings of the US courts and law enforcement;
44. Enquiries by various British authorities report that the US Department of State was not barring access to the child by refusing the father visas to travel for access;
45. The father can now show that this is a lie on the part of the US Department of State based upon recommendations and misrepresentations of Barbara Greig and the US Central Authority and that this continues to this day;
46. The child was located and returned in January 2006 to the State of Florida after hiding the child in Kansas/Missouri;
47. The father can now demonstrate that the child was hidden from the father and the US court proceedings with the active involvement of Barbara Greig of the US Central Authority;
48. The father can show that despite nine US and British eye doctors recommending treatment for the child, the US court and Floridian authorities have refused treatment for the child;
49. The child is now permanently blinded in the right eye as treatment needed to be administered and concluded by age 3 (the child is now 6);
50. It has been 5 years since the child was sent to the jurisdiction of Florida and there is still no ruling as to a final determination of the child’s future;
51. The child and father have been kept apart for more than two years and the Floridian court refuses to enforce any visitation order in defiance of the laws of that State;
52. The father believes he can now demonstrate a fraud on the High Court by US Government officials, an international child abduction of a child situate in the UK by misconduct of US Government officials in violation of the Hague Convention and other rights accruing to the father and child;
53. The father believes he can now demonstrate that the State of Florida does not satisfy the prerequisites for children to be sent to that jurisdiction under the Hague Convention, to wit:
a. The State of Florida fails to provide courts that will be prompt and effective in the rendering of court orders for the interest of a child;
b. The State of Florida fails to provide courts that will be prompt and effective in the enforcement of existing orders for the interest of the child; and
c. The State of Florida does not provide a standard of child protection at least the equivalent as that which a child would enjoy in the United Kingdom.


Proposed Relief in Broad Terms



The father believes that the following relief in broad terms should be sought:
i. An order quashing the Hague Convention ruling of Sir Justice Johnson on the grounds of fraud, perjury and bad faith conduct of the mother and Barbara Greig et al;
ii. Imposition of controls upon the US Central Authority by the High Court such that a Hague Convention application and supporting evidence is subject to independent corroboration before the matter is heard;
iii. That a requirement for a jurisdictional ruling by a US judge of the jurisdiction from which a child is alleged to have been wrongfully removed or retained be imposed on US applicants under the Hague Convention before the matter is heard;
iv. That the State of Florida be suspended from the Hague Convention in those cases where a medical condition requiring medical intervention exist and that the child(ren) subject to the application be retained in the United Kingdom for the pendency of medical treatment;
v. That for those cases were a child is to be sent to the State of Florida, only a named Federal Judge shall be allowed to hear the case and one who is versed in the Hague Convention and understands the obligations placed on the United States in respect of the child and the British parent being sent to that jurisdiction and that no child shall be released to the jurisdiction until said Federal Judge has seized the case;
vi. That an investigation is launched by a competent authority selected by the Honourable Court into the removal of Emily Rose Hindle and the issues raised by the father regarding perjury and misrepresentations by the mother, Barbara Greig and other US government officials to the British authorities and High Court and the abuse and neglect of the child, the father and international law as a consequence;
vii. That an injunction be issued to prevent any further removal of children from the jurisdiction of England and Wales on the grounds of domestic violence by the US Embassy and Consulates; and
viii. Any other relief that the Honourable Court deems fit.

1. That legal representation be appointed for the father;
2. That the court direct the applicant as to the form and filing of the matter;
3. That the court direct the applicant as to service on other parties and the nature of service and giving notice of the proceedings to other interested parties such as the State of Florida and the United States of America; and
4. Any other directions are issued as the Honourable Court deems necessary and fit.

The Reagan Wing - Barbara Grieg, US State Department, facilitates International Child Abduction

Karl Hindle has been working tirelessly for five years and spent more than four hundred thousand dollars investigating his daughter’s illegal abduction to the U.S. What he has uncovered is deplorable. The paper trail shows the United States government is in the business of illegal baby snatching and harboring criminals.

Emily would not have suffered the loss of her father for the last five years, or the vision in her right eye, if it weren’t for the Violence Against Women Act (VAWA.) And people like Barbara Grieg of the U.S. State Department who see it as an excuse for misandry and a license for lawlessness.



Hindle, a U.K. citizen met and fell in love with American Sheila Fuith while in New York. When she moved to the U.K. in 2001 she hadn’t mentioned the husband and daughters she’d abandoned. Emily was born in the U.K. on March 1, 2002. At 5-months-old Emily was diagnosed with esotropia caused by amblyopia. She needed patching therapy, a patch worn a few hours each day, or she would lose sight in her right eye.

In February 2003 Fuith decided to leave Hindle and return to the U.S. She knew he would object to her taking Emily, so she did what many women in her position have done. She accused him of domestic violence and sexual abuse of children. Thanks to VAWA, she needed only to speak the words.

Fuith was taken in by a battered women’s shelter, and given free legal aid by the U.S. government. With no evidence and no due process, Barbara Grieg authorized the illegal abduction. The U.S. Embassy in London issued a passport for Emily without her father’s signature as required by law. The forged signature was not notarized, and had the wrong date.

After arriving in the U.S. Fuith stopped Emily’s therapy. She then tried to give Emily away in a “baby switch.” She placed Emily with the family of Leslie Merriam, a three time convicted pedophile in Wisconsin. Karl learned of this and contacted local law enforcement.

Fuith needed only to claim Karl was harassing her, and the baby switch wasn’t investigated. A call to Grieg confirmed that Hindle was “dangerous.” Captain Alan Osowski never looked at Fuith’s phone when she told him numbers from “harassing calls from Hindle.” But he wrote he had in his report.

This was just the beginning of Hindle’s harrowing five-year journey to protect his daughter. Fuith has moved Emily dozens of times through several different states. She’s filed over 100 false police reports. And Hindle has received death threats.

Two police investigations in the UK and three in the U.S. cleared Hindle of all allegations. Fuith was found guilty of coaching Emily and making false allegations. Hindle was given court-ordered reunification with Emily.

Hindle said, “Emily met her elder brother (Max) and sister (Elizabeth) for the first time in almost 3 years…as we walked into the resort hotel, Emily asked me ‘Is this my family ?‘“



They enjoyed these visits, evidenced by these photographs, until Fuith made another false allegation and disappeared. Emily was then listed as missing and endangered.

Knowing all of this, Grieg didn’t just harbor Fuith all these years. She interfered whenever Hindle needed a visa to attend custody hearings, arranged his improper arrest, imprisonment and deportation by the immigration department, and tried to set him up to be arrested for violence. She had officers hiding in bushes while her cronies harassed Hindle. And all the while, during her many lawless and reprehensible actions, she allowed Emily to go blind.



Fuith is still enjoying VAWA-funded legal representation. Recently there was a conference call between Fuith, Hindle, their attorneys and the State Department. During the call Fuith recanted every allegation she has made against Hindle. Even hearing this, the State Department refused to budge. The reason? The allegations the mother has made.

Sheila Fuith is clearly guilty, yet has not received any punishment. Karl Hindle is completely innocent, yet has not been able to see Emily or get custody. Now the State Department wants to send him back to London to apply for a new visa.

Hindle said recently, “I’ve been here for 5 weeks, yet Emily and I have not seen each other. The judge will not enforce his orders, and the mother maintains visitation must take place in Panama City, 350 miles away. Emily and I last saw each other on May 28th, 2006!” Hindle is now on his way back to the UK without seeing Emily.

US Embassy Visa Shennannigans Take 3

Jeff Gorsky of the Department of State advised Judge Doyle in their telephone conference that for a 10 year multpile entry visa to be issued I would have to return to the UK and apply for one at the US Embassy London and they will then consider it.

The last couple of days, Jill Jones-Soderman and I have been trying to get an appointment to be interviewed for the visa at the US Embassy London.

The State Department advise that they will not give me an interview appointment date until

Here is an email I received back from Kathy Ruckman, Deputy Director of the Office of Childrens Issues at the State Department and inheritor of Barbara Greig's mess:

There was no visitation with Emily.

Judge Doyle is waiting on the issuance of a 10 year multiple entry visa (or not) before delivering his ruling as has been discussed with your Mr Gorsky.

The delay is not acceptable under the circumstances; I understand you have been advised of Judge Doyle's findings of fact regarding the mother and Barbara together with the recantation of all of the allegations by the mother.

At this point the ball is in the State Department's court as to whether it is going to get with the program or continue irregardless of Judge Doyle.

Note, that is for an interview so they will consider the visa, not a date to actually give me a visa.

It appears that despite Judge Doyle's direct intervention with the State Department they are still playing silly sods.

Meanwhile, we are still waiting on Judge Doyle's ruling - please just give me the order Judge - then it can be appealed and my New York apeal attorneys are all set to get started on it.

As I said to someone I feel an especial affinity for yesterday - keep putting one foot in front of the other it's all a game to these people.

Back in the UK

Arrived back home in London yesterday and got home a little after 5pm GMT having snored most of the flight home.

Jen, my fellow passenger must have been a saint with Hindle blowing zzz's and if you are reading this now, I hope you and hubby are having a great time in old London afer what was for both of us one heck of a camping trip at JFK!

It's Sunday dinner with the sprogs here and being regaled with Father's Day cards and pressies and I can say I'm happy to be home and back with the children I can care about, not least because they really care about me and the look on their faces and tears in their eyes cannot be faked.

I'm a lucky man to have these children.

Tomorrow it is time to start working on getting further down the road with this mess.

Exhausted as I feel, there is nothing on this earth that will stop me from going forward and ending this shambolic, dishonourable mess created by the US Department of State and Sheila.

Today is Father's Day and I am Emily's Dad - knowing my little girl is somewhere out there and despite all the crap she has been put through by incompetent and/or criminal US officials who are more concerned about covering their dishonest butts than they are about protecting Americans is not sufficient to motivate me to continue.

Because I love Emily Rose and she loves me is all the motivation I need to go forward and I will.

Friday the 13th for Home & Emily Rose

5.18am in bed in Nyack, NY and just as I am doing a final check on emails and online "stuff" that is terribly indispensable, I notice the date - Friday the 13th!

BLOODY HELL!

What a day to go flying across the Atlantic; if the pilot is out on the tarmac apron kicking the tyres on the aircraft, I think I'd better miss the flight.

Not to worry, I'm not superstitious and Friday the 13th is not exactly a day rooted in demonic myth but rather the Vatican. A Pope of yore ordered the massacre of various crusader knights whom his holiness felt had become too big for their boots. I think they were called Cathars and were located in southern France while this piece of Papal banditry took place on Friday the 13th and the date has since been synonymous with bad luck.

Sod the superstition as I'm looking forward to cool air, decent tea and excited mutts at home as in less than twelve hours I should be back home in the UK.

It's been a little weird to be honest, so much has been accomplished but in truth the only substantive thing that matters is Emily and we haven't seen each other at all.

Nothing.

No access; no telephone calls; no talking; no playing; no laughing; no time in any shape or form.

Winston Churchill said, "Success is the ability to withstand failure time after time and carry on."

Someone else said, "Insanity is doing the same thing over and over again in anticipation of a different result happening."

Never quit; never give in; keep going forward; stay cool; stay calm.

New York, 20 Questions, Pink Punk Rockers and Philmore the Jet Dog

I flew back to New York today and am safely and soundly esconced in the bosom of a huge bed in Nyack.

It was a heck of trip not least as I had to catch three buses to get from Ormond Beach to Edgewater some 30 miles away which took in the grimy underbelly of Daytona and as one who knows it well told me, "Daytona can best be described as a seedy, smelly used car salesman."

Whiling away the two hour flight, my fellow traveller Patsy from Lake County engaged in 20 questions as we swapped war stories. Patsy is a disgustingly mature lady and yet another living proof that Floridians age well and has a wicked sense of disgraceful mischief if the pink hair and Philmore, her ten month toy dog with a spiked collar and punk rocker motif going have anything to say. As a school teacher, I have no doubts that Patsy has more war stories of gore and mayhem than Oliver North.

I frequently invite my fellow passengers to engage in conversation as sitting quietly next to a complete stranger for a few hours in a plane just strikes me as distendedly uncomfortable. Patsy and I played the 20 questions game - you ask a question about me and vice versa, which gave me a lot of information on what is going on in Patsy's life - recently divorced, musician daughter in New York, called Emily (spooky), she likes beer (how can this woman be single?), teachers in Florida make less than a bus driver in London and so on. Needless to say there was a geat deal of discursive sidetracking but listening to people and their stories is fascinating. Forget in flight movies just insist that passengers talk to one another. The trip ended far too soon as I enjoyed the banter and badinage immensely, not to mention the desperate need that overtook Patsy to find the restrooms while we ended up waiting for an eternity to get to the gate after we landed.

That eternal conundrum, do I go now but the seatbelt sign is still on and everyone is looking or hold on until later?

Patsy: I trust the restroom "experience" was just what the doctor ordered ;)

Tomorrow I'm back into New York city with Sylvia Welch on a mission to raise the odd couple of million dollars; even better I'm driving so New York move over, I learned to drive in London. Sylvia is a grant writer, fund raiser and altruistic soul who can drink me under the table, is more than a match for my wit and game enough for me to practice my worn out dance moves on.

Lovely lady.

Jill is taking me to see the first Frozenheart House in the US which is on a compound on the Hudson River a few miles away and then we have to work out how it is going to be financed and who is doing the renovations. Finally, I have been promised an evening in Nyack which is something I have not yet sampled but would love to as it all looks pretty neat with cafe society and music galore for my two left feet made of concrete.

Friday morning sees me getting the bird for the hop back to the UK and hopefully Sunday roast with all the trimmings, Max and Dizzy and the mutts ....not to mention the coolest cat in the universe, Oscar.

Jeffrey Gorsky - Department of State Legal Eagle

My attorney, David Ferguson came by today.

A bitter sweet visit as his family have suffered a bereavement yesterday yet here he is working on a Sunday.

The next time someone wishes to gripe about lawyers, just consider that like everyone and everything else in life there are good, bad and indifferent.

David is in a very different category.

In a brief meeting conducted on the porch of my beach shack (actually his as he is also putting the roof over my head), David outlined the outcome of the Friday telephone conference between Judge Doyle and the Department of State's Jeff Gorsky.

The ineligibility for visas remains but I am able to reapply for a visa for entry if I return to London. I fnd it strange that the Department of State wishes to get me back to London to deal with this rather than just dealing with the inelgibility here and now so the judge can have some comfort that the US government is not pulling another bluff with an empty promise.

When questioned on what Judge Doyle and the lawyers can do to unblock the jam, the answer was nothing - as Kim Bannister, Sheila's attorney stated after the call, she speaks a couple of languages but not the State Department doublespeak.

I'm flying back to New York on Tuesday/Wednesday and hopefully will have an order from Judge Doyle who still wishes to keep Emily here in the US with her mother but if the State Department refuses the multiple entry visa that constitutes a change in circumstancs and His Honor will reconsider the custody issues.

This begs the question in my mind that a Floridian judge in possession of the evidence of blatant misconduct tied directly to the American mother, with a child who has been neglected to the extent of losing the sight in an eye, has attempted to have Emily adopted out and into the care of a convicted pedophile still cannot get his head wrapped around letting Emily come home to live in the UK?

One observer noted recently that if I was an American dad I would have custody of Emily by now but I live in the UK.

Which begs the question, how sending children to the US for "fair" proceedings to take place can occur if a court has such a mental block in considering the UK a suitable place for a child to be raised?

No point in getting angry or frustrated - one foot in front of the other and head for the UK and the British High Court with what has been uncovered and the result of sending Emily to the United States:
  • neglect and blindness;
  • coaching in making allegationsof the most evil and depraved kind;
  • a court that cannot be prompt nor effective and is being overridden by State Department officials such as Barbara Greig, police officers such as VCSO's Captain Osowski and an officer of the court, Teresa Anderson - and Judge Doyle does nothing ... there is nothing he can do anyway;
  • corrupt US government officials sacrificing a British child entrusted in good faith to their system when it is clear they have no faith in it themselves;
  • a month in jail for the British parent;
  • death threats;
  • 5 years of legal proceedings and no ruling (yet);
  • $430,000 in costs; and
  • most of all - I'm here and have been for 5 weeks, yet Emily and I cannot see each other as the judge will not enforce his orders and the mother maintains visitation must take place in Panama City, 350 miles away after agreeing to Volusia County where I am staying - Emily and I last saw each other on May 28th 2006!

If you are an American parent having to deal with getting your child returned to the United States - what kind of endorsement is all of this when you face a judge in Europe, or worse the UK?

You may be a great mom or dad but are your officials to be trusted?

I say "No!", but it will have to wait to see if the High Court in London agrees with me that if a child is in the UK, sending your child to the United States is a mistake that cannot be allowed to stand under the existing circumstances of US Department of State dishonesty and deceit.

Letting a child go blind in an eye for the sake of a fifty cent eye patch with nine British and US doctors recommending treatment, a British Supreme Court judge ordering it and an order made under international law (powerful law binding on the US).

Wake up America!

You guys are generous, honest and fair - but US government officials, such as Barbara Greig are not and as Judge Doyle advised me in court, "Mr Hindle, the federal government is screwing you!" but in truth, the Department of State's Office of Childrens Issues have created a disgusting reputation and track record in these cases that will haunt you when you stand before a judge in a foreign land begging for the return of your children.

First off - the telephone conference took place on Friday with Judge Doyle and a State Department legal eagle named Groesky.

I am still barred from a visa being issued for coming to the US for visitation despite the recantation of the mother's allegations. I wonder what Judge Doyle is now going to make of this as this means visitation can only take place outside of the US or indeed, is it not time for Emily to be returned home to the UK?

We shall see but as one pundit observed, "You have an American judge in an American court he's going to favour the American party on this no matter what."

I am inclined to agree.

Yesterday was a day of fishing on North Ormond Beach with Gator Bob, an American reprobate of the first degree and a very colourful character who introduced me to fishing for real. In a matter of seconds I had a baby hammerhead on the hook which did not look best pleased but at about a foot long, there was very little he could do except suffer the indignity of being caught by a limey fishing novice.

After a day of catching the rays (and I mean the sun variety as the fish dried up pretty quickly), it was a brief retirement to Peckers Pub for the Big Race and Big Brown, the 4-1 on favourite for the 140th Belmont Stakes and part of the horse racing Triple Crown over here. In quite an upset he finished last to the dismay of many and the sniffy queries of the cognescenti asking what went wrong - "It's a fix!" said one wag and I agreed.

There's something rotten in the state of "Denmark" Willy Shake once wrote, and there seems to be an all pervasive whiff here in the US too concerning virtually everything.

Nevertheless, time to get ready for another boringly beautiful day on the beach while I slurp my third morning coffee and wait for Monday and what Judge Doyle comes up with.

Morning Coffee at Peckers Pub

Friday morning watching a movie with fresh coffee at what has become my local; Peckers Pub.

I heard yesterday the telephone conference with Judge Doyle and the State Department is scheduled for 1.30pm local time and we will see what that brings.

Personally I think it will more stalling and bogus nonsense from the State Department however this is a pretty pickle - Sheila has agreed to recant all of her allegations she has been making against me over the last 5 years so who could the State Department be protecting now?

I'm also flying back home next Friday and will be heading to New York shortly.

I've been here over a month and have not seen Emily and now it appears I will not be getting to see her at all as there is no cooperation from her mother and her attorney, Kim Bannister.

hmmmmmm.........

At least we will get a final ruling out of Judge Doyle and we can move forward with the process which is why I'll be spending a few days in New York before I head for home.

The Laughter of Dolphins

Hardly slept last night and I am slowly going round the twist as nothing is happening as left hand tries to figure out where the right hand is never mind what it is doing. A court and a government department trying to talk to each other - a recipe for sluggishness and absolute disaster if ever there was one.

Grabbed a coffee and went out to watch the sun rise at 5.30am only to find a school of dolphins playing off the sand bar about 10 yards from the shore. I waded out onto the sand bar and a couple of the bolder ones came up to inspect me at close range; the sun found me today, up to my thighs in warm Ormond ocean with dolphins chattering and squeaking at me.

While I was standing there and getting an occasional nudge from one cheeky flipper, small squadrons of pelicans skimmed the water which was smooth and unhurried.

It dawned on me that the wildlife was laughing at me as they were all demonstrating far greater success at fishing than I have these last few days.

I collected my rod and tackle and cast out where the birds and dolphins had been concentrating their efforts only to have my hook and bait taken in a matter of seconds.

I could hear the laughing as I walked up the beach and over the walkway back to my shack for more coffee and preparation for a day with my lawyer.

After walking into my attorney's offices from the beach shack, which is a 3 mile stretch, the heat takes it's toll and a quick trip for a new shirt was needed. The Americans think I'm nuts because I walk into the office - my response has always been;
"Man places one foot in front of the over and repeats as required; it's called walking!"
There appears to be some movement regarding this State Department/Judge Doyle conference call as a legal adviser to the US visa section is willing to take Judge Doyle's call but unfortunately I still have no news on seeing Emily despite being here a month. I should leave on the 6th June so I doubt I will be able to see her and it is required I leave as originally planned because of the visa issues with the State Department and US Embassy, London.
I spoke with an English friend earlier and he sounded more peeved than I do; a month there and still no Emily!!
Suck it up Karl, build that bridge and bloody well get over it but stay cool, stay calm and never quit.

Sol Orior - Absentis Everriculum

Pardon my terrible latin but after this morning and the day I have had, something linguistically special is required.

Woke at 5am and went for a run in the cool before dawn, it was light and the beach was empty apart from the odd early bird and the surf sound that lulled me to sleep last night.

Coffee from the donut shop across the road and walk the 20 yards or so to the beach to watch sun rise (sol orior) where, after watching a breathtaking sun burst I met Tony, one of my neighbours.

Tony is a surf fisherman, or at least he bluffs it very well with these surf rods and holders. Claiming he never catches anything, he has me holding his spare rod as the other one nearly bends in half and a few seconds later a foot long Blue Fish is wriggling on the sand at our feet. Being a brave sort, Tony looks at me with bemusement and confesses he's never had to take a fish off the hook before and lot's of laughter on both sides (except the fish wasn't laughing).

After such an introduction, Tony has given me a rod and some tackle and I have spent the day - absentis everriculum or gone fishing - casting off Ormond Beach in my hunt for Moby Dick or one of his breathren, alas nothing but it has been a fantastic day and I am very brown.

I printed some photographs of the day off my camera and came across my last fishing trip - crabbing with Max and Dizzy at Prittlewell in Essex. Seeing them on that day makes me weep inside for home and a cuddle with them; I'd even put up with their TV programmes blaring and have a smile on my face.

No news on Emily - hoped something would happen this weekend for visitation but nothing but Judge Doyle did fax the State Department's Kathy Ruckman to set up this conference.

Welcome to the Home by the Sea

It's official - I am a beach bum!

I moved into a beach house yesterday in Ormond by the Sea on the east coast of Florida about spitting distance north of Daytona.

Up early in the morning in time to watch the sun rise with a complete and utter muppet bluffing tai chi exercises in front of an otherwise pristine view.




No sign of Emily and no telephone call either. No point in getting your hopes up in this situation - better to be a born pessimist I feel so you are never disappointed.

Judge Doyle has faxed a letter up to the State Department as requested and maybe the visa situation will get unblocked or not - we shall see.

Other than that, I have spent a day cleaning my apartment and I'm going swimming in the dying hours to wash off the heat of the day - exercise is something I seem to be getting a lot of at the moment as I went swimming this morning, had a couple of miles walking on the beach followed by a 3 mile run into my attorney's office.

I think my family will take one look at me and ask "Who are you and what have you done with Dad?"

Sorry Dizzy but alas - I am no longer the BFG - love you sweetheart and miss you all terribly.

Interminable Waiting

One more day comes to a close and one more day of utter and absolute frustration that rages against my power of self-control.

People ask me how I stay calm and cool in this situation and I think of the saying "If you can keep your head when all around are losing theirs...." but more intrusive on my mind are the P Company instructors yelling at a raw recruit to stop flapping and switch on!

I tried to arrange to send a child support payment through Paypal but the mother's attorney, Kim Bannister of Central Legal Services in Daytona simply claims Sheila has no email ... given the number of emails she has been sending to all and sundry claiming me to be variously domestically violent, sexually abusive in the most graphical detail and generally an all round bad egg, I am stunned that she does not have an email address anywhere either for her or anyone else in her family that can accept this online payment and transfer it to her bank account.

After getting "badgered' by Kim in court on Friday on why her client was not getting child support payments I find it strange that they are not biting my hand off to take my money for child support?

No sign of the State Department telephone conference either and the gist of access with Emily is to go to Panama City about 300 miles away in the Pan Handle for visitation when we have a deal that says I get to Volusia County and Emily will come here - seemed fair, I travel 3,500 miles to get here and Sheila travels 300 to meet me less than 10% of the way.

Mark me well; if I go to Panama City for visitation with Sheila Fuith, Debbie Martin and Cathy Bodin - three sisters all of whom have played the domestic violence card to the hilt in their lives, divorces and custody disputes in their collective past, I fully expect fireworks in Bay Countyif I go there.

Think I'd better get the British Consul's telephone numbers sorted out and ready to hand just in case or should I simply ensure I have medical insurance for the next time a redneck decides he's going to kill me or just beat the shit out of me because he's enraged at "poor" Sheila's plight and I'm such a "turd" that could do this to a child?!?

I doubt the next wave of allegations will be in the past if I travel alone to Panama City to see Emily and I do not mind admitting I am bloody scared of doing that or of being with Emily anywhere except in a very public place.

Tomorrrow I move to yet another location and another couch or maybe it will be an airbed, up in Ormond Beach. My attorney, David Ferguson has placed at my disposal an apartment up there and I need some time on my own and for all that moan about how lawyers are scum sucking, bottom feeders, don't say that about David anywhere near me; David Ferguson is a grade A, first class, honourable and thoroughly decent human being.

Nevertheless, there is a yearning for my family and the people I love that is tearing the heart and soul out of me but I cannot and will not quit on Emily.

If you ever are in any doubt that staying in your child's life is not worth the cost just look at the photograph of Emily and I when we were reunited in January 2006. Our first meeting and we were both happy and in love as fathers and daughters across the world can only be.

Never give in, never quit, keep calm and always keep putting one foot in front of the other but never lose sight of why you are doing it; because you love your children and they love you so leave your anger and hate behind, they will only change you into something hideous.

Judge Doyle: "Mr Hindle, the Federal Government is Screwing You!"

Well yesterday we had a day of trial but there is no ruling at this time after what has been an extremely bizarre hearing that twisted as much as any John Grisham novel.

Initially we were getting hammered by Judge Doyle because we had asked for a continuance as evidence is still in transit from the UK.

Ouch!!

Seeing a judge in full swing is worse than a heavyweight coming at you believe me.

As the day progressed Judge Doyle latched onto the State Department interference and tied the mother and Barbara Greig at the Office of Childrens Issues directly together.

His Honor Judge John Doyle refused to issue any ruling and is going to attempt a conference call with the State Department, the attorneys and himself to unblock the hash the State Department has created with Sheila in blocking access to the United States.

As His Honor noted, there are plenty of people here illegally who never have any problems so why are they picking on me.

Best of all though was I got to see a photograph of Emily taken a day or two ago - she's a beautiful child said Judge Doyle, and I replied she takes after me and giggled.

I was hoping to see Emily today but that isn't happening but hopefully I will next week when school is out.

Much more to report but not enough time.

Florida at Four

I spoke with Emily last night for the first time in months. Something tells me mom is now switching on and is behaving herself in readiness for Judge Doyle.

Window dressing.

Emily was clearly being coached with some of the things she was saying - I asked her if she like to go to Disney "I don't like Disney!" - yeah, right!

23rd May 2008 - and Judge Doyle is getting this whole bag of snakes laid out for him so play some more games because it isn't going to wash.

Awoke this morning in New York at the ungodly hour of 4am so I could get my ride to La Guardia and a flight down to Orlando, Florida.

Packed and ready to go after an evening carousing with Jill and Sylvia; I listened as Sylvia kept mentioning this nephew and that great nephew and so on and so on. While she was guzzling the Laphraoig with me (a gift from Jill) I couldn't help but wish she was my aunt too and I felt very comfortable with Jill at my side mothering me and Sylvia verbally fencing.

Lovely women.

A brief ride to the airport and laughing and joking with Joseph who does all the driving around picking waifs and strays up for Jill. Top bloke who has now gotten the correct pronunciation of "bollocks" down to a tee.

3 hour flight down into Florida and the cool, sociable New York weather becomes the humidity of the sub tropics. Listening to a congregation of coloured women swapping tales of husbands, ex husbands and boyfriends with each other in voices so loud they didn't need a tannoy system and they were seriously funny!

Taking off the plane commenced a sharp left then right hand turn taking us over Manhattan with a pivot around Central Park. That iconic skyline I had missed on my initial arrival was briefly laid out as the cloud shrouded the city in a fade to black shot any film director would have been ecstatic to have caught and in a moment, bursting sun pouring into the cabin as we cleared the cloud layer. New York has a hold on me for life, not least as that is where I met and fell in love with Emily's mother.

Now here in Orlando and feeling the heat. Hopefully will see Emily on Saturday but they are baulking at visitation as my attorney, David Ferguson said yesterday - apparently it is Mothers Day on Sunday. Emily has never had a Fathers Day so get over to Volusia County on Saturday and do whatever you are doing on Sunday - stop screwing Emily over for spite.

Anyway, we shall see what pans out and I'm heading back to New York on the 17th to meet up with David Bennett and crew.

New York & Thoughts on Jill Jones-Soderman

Nyack is about 40 minutes drive north of New York City where I flew in on Monday.

The impressive New York skyline was not to be seen with its Manhattan skyscrapers as we skirted to the north of the city and I was sitting on the wrong side of the plane to see it anyway as we came in for wobbly landing.

I thought it was just as well as the last time I came to New York was in December 2000 and the Twin Towers dominated and of course they are no longer there.

I remember meeting the Twin Towers for the very first time, coming off the underground train and walking a block to the plaza where they were situated but having my view of them obscured by the surrounding urban skyrises that blocked out the sky as you walked in their shadow.

The hustle and bustle of a big city The Big Apple which never sleeps while at ground level those distinctive yellow cabs plied their trade punctuated by the wail of a siren from a patrol car and everywhere, people going about their business.

It was cold with a bite that told you you were not in London but apart from that it could have been.

New York has its own electric ambience that I have only felt in London.

A determined purpose generated from the human morass and miasma.

Not catching the skyline today leaves me with the perfect vision of New York before 9/11.

Sitting here with my first coffee of the day and one of the dogs snoring by me, this feels like home. Extremely relaxing and I have slept well again for a second night. I think that had something to do with the bottle of Bowmore scotch my host bought for me; Jill Jones-Soderman.

The company is excellent here with Jill and her lovely daughter, Gillian, herself a 19 year old student with a penchant for working out at the gym late at night. I have suggested that if she desperately has the urge for exercise she should try a cold shower - that usually works for me!

I keep thinking how relaxed and comfortable I feel and the fact that I should be feeling nervous and apprehensive but not a bit of it. Hopefully I shall be seeing Emily on Saturday but I am cpurposely old inside as I do not wish to get my hopes up. Jill and Gillian make sure I am not left alone and except for this early hour as I drink coffee and listen to the sounds of a small town waking up with brilliantly red cardinals flying around the garden I have been treated like a king.

I can feel the stomach pangs as my emotions try to dictate how I should feel ,however I will not succumb; my head is ruling my heart.

Tomorrow I fly down to Florida and have to start thinking of how to get my papers down there with me. I don't want to go in a way; I haven't sampled Nyack night life but it does exist as I had a taste of the cafe and bar society that exists downtown while driving home with Jill. An all too brief visit yesterday had me playing guitar with a young man called Mike who was jamming away in an empty bar that had been opened so staff could clear out the trash. Swapping stories of Fender Strat ownership and trying to get my fingers to remember that they can play the strings as I rendered a terrible version of the solo in Pink Floyd's Another Brick in the Wall but made do with the E chord power trip you only get from 20th Century Boy.

Returning home, I satisfied myself with my bluff at being a raconteur with Jill and Gillian and making them giggle though I wonder if they were justhumouring their guest by laughing at his crappy jokes. Imbibing far too much 10 year old malt whisky left me feeling pleasantly exhausted and a sleep of the blessed has left me up at 6.30 and feeling fresh as a daisy.

I should be back here again on the 17th for a day and a night as there is a big pow wow with the Foundation's head honchos and this will reunite me with David Bennett of London pub crawl fame. He wants a rematch in the matching wits stakes so it is only polite to let him take me on on his home turf. I'll be gentle.

As the whirlwind that is Gillian has now arrived in the kitchen it is time to close this and look to another day.

Lost in America

OK, I'm not lost but chilling out in upstate New York with my hayfever giving me a real dose.

Sitting here in the kitchen overlooking the garden and feeling a warm breeze wafting in from the lake is heaven after a good nights sleep after two days of none.

I arrived yesterday and was interviewed by US Immigration, particularly about why I was deported in 2004 - the official was very understanding and simply wrote a date of departure in my passport looked at me and said have a nice stay. Thank you very much you lovely woman you - as I was picking up my papers she just said "Sorry about your daughter." and I looked her in the eye - I hadn't said anything about Emily but she obviously knew from looking at her computer screen.

Amazing how sensitive I (think) have become at picking up on moments of humanity - she knew what had happened and she wasn't happy about it; from the sucking of air between her teeth she did on occasion as she was reading from her computer screen it was clear she hadn't been happy and I was stealing myself for the very worst - getting turned around and sent back to the UK.

In fact she did exactly the opposite and after I packed my papers and my passport with a visa stamp in it, I shook her hand and said "Thank you."

An hours journey through rush hour New York traffic has brought me out into a small town called Nyack, and after a late night shopping trip I now have a clean set of undies, socks, couple pair of trousers and three or four shirts plus shaving cream and toothpaste.

The look on the US Customs officers face after clearing immigration was a classic. He had me open my suitcase and he quickly asked,"Where are your clothes?" - I was wearing everything and the case was packed with legal papers. After I explained the situation he smiled and passed me but not before confiscating a couple of tims of mushy peas and Sainsbury's basics curry sauce for Cindy, my custody attorney's paralegal.

Received an email from Cindy and she wasn't happy about that!

I also had a telephone call with David Ferguson, my attorney, who is trying to arrange visitation with Emily. We are looking for Saturday but we shall have to see so I am getting ready to fly down to Florida on Thursday or Friday depending on logistics.

Max and Dizzy - here's a message for you - Dad loves you very much and be good for Mum - see you all soon and look in on this tomorrow as I may have a surprise for you.

This time tomorrow I'll be on the plane and somewhere over the Atlantic south of Iceland en route to New York.

I have to say that I am chewing my arms off here with the interminable waiting - after so long I should have learned patience but when it comes to it, in these final hours I am becoming agitated and just want to go now.

Trial Date Set - 23rd May 2008

Docket sounding took place yesterday and a trial date has been set for 9.30am on 23rd May 2008.

Finally, after over 5 years of international cat and mouse, Emily Rose will now have the issues that confront her heard by a judge, His Honor Hudge John V Doyle at the Volusia County Courthouse in DeLand, Florida.

Given the inordinate delay in letting the court hear the case, Emily Rose has become permanently blinded in her right eye - she needed her medical treatment to have been concluded by the age of 3. I don't think Judge Doyle is going like what he is going to see so I have a personal message to the following:

Here's some 101 in Dealing with Emily's Dad:

1. don't lie - you get caught eventually;
2. children being allowed to go blind is not acceptable just because it is not life threatening;
3. children are not given to convicted pedophiles as part of child protection arrangements
4. do what the judge tells you - they are called "orders" for a reason;
5. obey the law - it is generally a very good idea;
6. do not falsify reports (Captain Osowski, Roberta Miranda & Barbara Greig in mind here) - you get caught eventually;
7. the most powerful force on the planet is the love and bond between children and their parents - interfere with that at your own considerable peril;
8. Judge Doyle is a rare breed in my experience of US officialdom - His Honor is honest, uncorruptible, and has integrity - His Honor is not stupid - you all have made me out to be a monster but I think you are more frightened of His Honor than Karl Hindle.
9. Gandhi took on an Empire and won - "First they ignore you, then they ridicule you, then they fight and then you win." - guess where you are right now on this curve and keep guessing because I know exactly where you are - in a bare knuckle fist fight and this is going to get bloody as hell (in a completely metaphorical lawful way); and
10. Henry Kissinger on dealing with terrorists said, "Pursue them coldly and relentlessly, with no emotion and let them realize there is nowhere to hide."

Better yet;

Currently, all contact with Emily Rose has ceased and we have heard nothing back in respect of various requests to arrange access for Emily and I.

There is a huge worry in my mind that Sheila, Emily's mother will not show or has disappeared again but that is secondary as I am thinking more that I may get to see Emily Rose again after two years.

Last time I visited the US, Emily Rose had been locaed up in Kansas/Missouri and we had had no contact for eighteen months - when we were first reunited I asked her if she knew who I was and she said "You're Dad!" - so I have no doubts Emily Rose will know who I am this time around.

The question in my mind is how much poison has Sheila put into Emily Rose's head?

Cartoon Studios Becomes First Frozenheart Corporate Sponsor

Well the internet does work!

After an initial launch of the Frozenheart web site, a flurry of responses from around the world and from many people who have contacted me for the very first time.

Remember the primary aim intially is to establish a world wide network of accomodation for parents that is no cost for left behind parents travelling abroad to recovery their children.

An unexpected fringe benefit that is going to start taking centre stage is an email I received from Richard Duszczak of the Cartoon Studio Limited in the UK.

The Cartoon Studio have offered to become a corporate sponsor for Frozenheart and have kicked this off with £500 worth of free artwork and logo design and other support as well.

Frozenheart Website

In between getting packed and sorting out paperwork and evidence to carry over to the US on Monday, I finished my very first website and published it in the wee hours.




I'm signing the papers next week in New York to register Frozenheart as a registered non-profit in the United States so all in all it is going to be a busy month in the land of the free.

Pay a visit to Frozenheart and see what you think - we are also building a network of accomodation for parents that need help with having a place to stay while away - both in the UK and the US. I'm arranging to discuss with some contacts in Australia, New Zealand and South Africa to try to get something moving over there but if you have a place where a parent can stay while trying to get their kids back send me an email or contact me through Frozenheart.

Let's Go!! versus Let's 'Ave Some!!

The clock is slowly counting down to getting on the plane and heading Stateside - 5th May cannot come quickly enough but then neither can the return flight as it is an ambivalent trip - seeing Emily again hopefully after two years and leaving my family behind for 5 weeks.

It is a dilemma that parents in this situation face but then we are the lucky ones - while I am itching to get in there and do the business I am mindful of other parents who have never been allowed the opportunity and never see or hear from their children again.

For me it's "Let's Go!" and I'm bloody lucky to be able to do this.

I had a telephone conference with my custody attorney, David Ferguson in Ormond Beach, Florida a few days ago too.

He spoke with a Mr Gleeson at the US Department of State with regards to getting the deposition of Barbara Greig at the Office of Childrens Issues at the Department of State in Washington DC.

"She's got a job to do and is too busy.", was the response to Mr Ferguson's repeated requests for her evidence and as David told me "The more you keep saying "No" the more I think you have something to hide."

Well, if Barbara Greig and the Department of State are not prepared to stand up and give their evidence in a court of law that speaks volumes - the silence is deafening.

I chuckled a little too as I was thinking of when Dizzy my eldest daughter (real name is Elizabeth but Dizzy is my pet name for her) was playing a Wii game - bowling. The Mumbling Midget (my other pet name) is a pocket dynamo and taking a run across the living room floor yelled out as her bowling ball went whizzing down the virtual alley - "Let's 'Ave Some!!" - coming from such a tiny person we all laughed but not when she had three strikes in a row.

Who cares, we are going to "Git 'r' Done!" - hey, it is happening in Florida after all :)

Visa Shenaniggins Part 3


Loud knock on the door this morning as I was slurping a coffee after packing the little darlings off to school.

"I have a passport for you sir, from the US Embassy."

Sign for the packet and rip it open to see if the visa is real - yes it is but ....

Hang on a minute?

Expires on 20th May?

But trial period as Judge Doyle wrote to the Embassy is for three weeks starting on 12th May!
The US Embassy made me buy flights before they would issue the visa - the return flight is June 7th - they know this!

In other words you can go to the US but you have to leave before the trial has finished - perhaps before it has even started.
